A MEMORIAL

REQUESTING THAT LOCAL AND REGIONAL GOVERNMENTS BE ADVISED OF
THE POTENTIAL BENEFITS OF FLOOD CONTROL DISTRICTS AND THE
AVAILABILITY OF THE FLOOD CONTROL DISTRICT ACT TO CREATE LOCAL
AND REGIONAL FLOOD CONTROL DISTRICTS.

WHEREAS, communities throughout the state have experienced
significant flood damage during the past few years; and

WHEREAS, the potential for flood damage is increased as a
result of wildfires that destroy forests and other cover
vegetation; and

WHEREAS, the potential for wildfires in New Mexico has
increased due to the effects of climate change; and

WHEREAS, flood control districts can be an effective means
of preparing for and dealing with flooding; and

WHEREAS, the Flood Control District Act, Chapter 72,
Article 18 NMSA 1978, provides a means for the formation of
local and regional flood control districts; and

WHEREAS, local and regional governments may not be aware
of the availability of the Flood Control District Act as a
means for the formation of local and regional flood control
districts;

NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF
REPRESENTATIVES OF THE STATE OF NEW MEXICO that the New Mexico
association of counties and the New Mexico municipal league be
requested to advise their members of the benefits that may be
obtained through the formation of flood control districts and
the availability of the Flood Control District Act, Chapter 72,
Article 18 NMSA 1978, as a vehicle for forming local and
regional flood control districts; and

BE IT FURTHER RESOLVED that copies of this memorial be
transmitted to the executive director of the New Mexico
association of counties and the executive director of the New
Mexico municipal league.
