        AN ACT to amend the retirement and social security law, in relation to a
          waiver  of  earnings  limitations  for certain retired law enforcement
          officers

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section  1.  Section  211 of the retirement and social security law is
     2  amended by adding a new subdivision 10 to read as follows:
     3    10. NOTWITHSTANDING THE  PROVISIONS  OF  THIS  SECTION,  SECTIONS  TWO
     4  HUNDRED  TWELVE  AND  FOUR  HUNDRED ONE OF THIS CHAPTER AND SECTION FIVE
     5  HUNDRED THREE OF THE EDUCATION LAW AND ANY OTHER LAW, REGULATION,  RULE,
     6  LOCAL LAW, OR CHARTER TO THE CONTRARY, A RETIRED LAW ENFORCEMENT OFFICER
     7  MAY  BE EMPLOYED AND EARN COMPENSATION IN A POSITION OR POSITIONS IN THE
     8  SERVICE OF THE OFFICE OF THE SPECIAL COMMISSIONER OF INVESTIGATIONS  FOR
     9  THE  NEW YORK CITY SCHOOL DISTRICT WITHOUT ANY EFFECT ON THEIR STATUS AS
    10  RETIRED AND WITHOUT SUSPENSION OR DIMINUTION OF THEIR RETIREMENT  ALLOW-
    11  ANCE  AND  WITHOUT  PRIOR  APPROVAL  PURSUANT TO SUBDIVISION TWO OF THIS
    12  SECTION. EARNINGS RECEIVED  AS  A  RESULT  OF  EMPLOYMENT  IN  A  SCHOOL
    13  DISTRICT  OR  A  BOARD  OF COOPERATIVE EDUCATIONAL SERVICES IN THE STATE
    14  SHALL NOT BE APPLIED TO A RETIRED PERSON'S EARNINGS WHEN CALCULATING THE
    15  EARNINGS LIMITATIONS IMPOSED BY SUBDIVISIONS ONE AND TWO OF SECTION  TWO
    16  HUNDRED TWELVE OF THIS ARTICLE.
    17    § 2. This act shall take effect immediately.
