        AN ACT to amend the alcoholic  beverage  control  law,  in  relation  to
          creating a special on-premises license for certain properties

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. The alcoholic beverage control law is amended by  adding  a
     2  new section 97-e to read as follows:
     3    § 97-E. TWENTY-FOUR HOUR LICENSE TO SELL LIQUOR, WINE, BEER, AND CIDER
     4  AT  RETAIL  FOR  CONSUMPTION  ON  THE PREMISES.   1. NOTWITHSTANDING ANY
     5  PROVISIONS OF LAW TO THE CONTRARY, THE  LIQUOR  AUTHORITY  MAY  ISSUE  A
     6  TWENTY-FOUR  HOUR  RETAIL  LIQUOR,  WINE,  BEER,  AND  CIDER LICENSE FOR
     7  ON-PREMISES CONSUMPTION TO A FACILITY WHICH:
     8    (A) IS LOCATED WITHIN  A  DESIGNATED  INDUSTRIAL  OR  ECONOMIC  ZONING
     9  DISTRICT;
    10    (B) OCCUPIES NOT LESS THAN TWENTY THOUSAND SQUARE FEET OF FLOOR AREA;
    11    (C)  IS UTILIZED FOR THE PURPOSE OF HOSTING ENTERTAINMENT OR CULTURAL,
    12  SOCIAL, OR COMMUNITY EVENTS; AND
    13    (D) IS LOCATED AT LEAST FIVE HUNDRED FEET FROM A RESIDENTIAL BUILDING.
    14    2. ANY LICENSE ISSUED PURSUANT TO THIS SECTION SHALL BE SUBJECT TO ALL
    15  PROVISIONS OF THIS CHAPTER NOT INCONSISTENT WITH SUBDIVISION ONE OF THIS
    16  SECTION AND MAY BE SUBJECTED TO SUCH RULES BY THE LIQUOR AUTHORITY AS IT
    17  DEEMS NECESSARY AND SUCH RULES AS ARE IN CONFORMITY WITH THE  PROVISIONS
    18  OF SUBDIVISION ONE OF THIS SECTION.
    19    §  2.  This  act shall take effect on the ninetieth day after it shall
    20  have become a law.
