        AN ACT to amend the election law, in relation to requiring signatures on
          a voter registration form to be notarized and  providing  a  fail-safe
          registration method

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. Subparagraphs (viii) and (xii) of paragraph (k) of subdivi-
     2  sion 5 of section 5-210 of the election law, as amended by  chapter  113
     3  of  the  laws of 2023, are amended and a new subparagraph (xiv) is added
     4  to read as follows:
     5    (viii) A statement informing the applicant that if the form is submit-
     6  ted by mail [and the applicant  is  registering  for  the  first  time,]
     7  certain  information  or  documents [must] MAY NEED TO be submitted with
     8  the mail-in registration form [in order to avoid additional  identifica-
     9  tion  requirements upon voting for the first time]. Such information and
    10  documents [are] MAY INCLUDE:
    11    (A) [a driver's license or department  of  motor  vehicles  non-driver
    12  photo ID number; or
    13    (B)  the  last four digits of the individual's social security number;
    14  or
    15    (C)] a copy of a current and valid GOVERNMENT ISSUED photo identifica-
    16  tion; [or
    17    (D)] AND
    18    (B) a copy of a  current  utility  bill,  bank  statement,  government
    19  check,  paycheck  or  other  government document that shows the name and
    20  address of the voter.
    21    (xii) A place for the applicant to execute the form on a line which is
    22  clearly labeled "signature  of  applicant"  preceded  by  the  following
    23  specific form of affirmation:
    24    AFFIDAVIT: I swear or affirm that:
    25       * I am a citizen of the United States.
    26       * I will have lived in the county, city, or village for at least 30
    27         days before the election.

         EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1       * I  meet  all  the  requirements  to  register to vote in New York
     2         State.
     3       * This is my signature or mark on the line below.
     4       * All  the  information  contained  on  this application is true. I
     5         understand that if it is not true I can be convicted and fined up
     6         to $5,000 and/or jailed for up to [four] SEVEN years.
     7  which form of affirmation shall be followed by a space for the date  and
     8  the aforementioned line for the applicant's signature.
     9    (XIV)  A  SPACE FOR AN APPLICANT'S SIGNATURE TO BE NOTARIZED, ACCOMPA-
    10  NIED BY THE FOLLOWING STATEMENT:
    11    "IN ORDER FOR THIS APPLICATION TO  BE  DEEMED  COMPLETE,  EITHER  YOUR
    12  SIGNATURE,  ACCOMPANIED  BY THE LAST FOUR DIGITS OF YOUR SOCIAL SECURITY
    13  NUMBER, MUST BE NOTARIZED, OR, IF YOUR SIGNATURE IS NOT NOTARIZED,  THEN
    14  YOU  MUST  PROVIDE A COPY OF A CURRENT AND VALID GOVERNMENT-ISSUED PHOTO
    15  IDENTIFICATION AND A COPY OF ONE OF THE FOLLOWING DOCUMENTS  THAT  SHOWS
    16  YOUR NAME AND ADDRESS:
    17       * A CURRENT UTILITY BILL;
    18       * A BANK STATEMENT;
    19       * A GOVERNMENT CHECK;
    20       * A PAYCHECK;
    21       * OR OTHER GOVERNMENT DOCUMENT;
    22  AS  PRESCRIBED  BY  THE NEW YORK STATE BOARD OF ELECTIONS, REGARDLESS OF
    23  WHETHER YOU ARE REGISTERING TO VOTE FOR THE FIRST TIME, OR CHANGING YOUR
    24  CURRENT VOTER REGISTRATION STATUS."
    25    § 2. Subdivision 5 of section 17-104 of the election law is amended to
    26  read as follows:
    27    5. Knowingly permits, aids,  assists,  abets,  procures,  commands  or
    28  advises another to commit any such act, is guilty of a CLASS D felony.
    29    §  3.  This  act  shall take effect on the sixtieth day after it shall
    30  have become a law. Effective immediately, the addition, amendment and/or
    31  repeal of any rule or regulation necessary  for  the  implementation  of
    32  this  act  on its effective date are authorized to be made and completed
    33  on or before such effective date.
