        AN  ACT  to  amend  the  executive law and the general municipal law, in
          relation to requiring a  police  officer  accompanying  federal  immi-
          gration  officers  to  wear  and  use  a  body  camera  and secure the
          recordings

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section  1.  Paragraphs (h) and (i) of subdivision 2 of section 234 of
     2  the executive law, as added by chapter 105 of  the  laws  of  2020,  are
     3  amended to read as follows:
     4    (h) any interaction with an emotionally disturbed person; [and]
     5    (i)  ANY INSTANCE WHEN AN OFFICER ACCOMPANIES OR IS IN THE PRESENCE OF
     6  AN AGENT OR OFFICER OF THE U.S. IMMIGRATION AND CUSTOMS  ENFORCEMENT  OR
     7  OF U.S. CUSTOMS AND BOARDER PROTECTION WHO IS PERFORMING IMMIGRATION-RE-
     8  LATED DUTIES; AND
     9    (J)  any instances where officers feel any imminent danger or the need
    10  to document their time on duty.
    11    § 2. The general municipal law is amended  by  adding  a  new  section
    12  208-i to read as follows:
    13    §  208-I.  BODY-WORN  CAMERAS. 1. EVERY POLICE DEPARTMENT IN A CITY OR
    14  COUNTY HAVING A POPULATION OF TWENTY  THOUSAND  OR  MORE  AND  THAT  HAS
    15  INSTITUTED  A  BODY-WORN  CAMERA  PROGRAM SHALL REQUIRE OFFICERS OF SUCH
    16  DEPARTMENT TO WEAR AND TURN ON SUCH BODY-WORN CAMERAS  IN  ANY  INSTANCE
    17  WHEN  THE OFFICER ACCOMPANIES OR IS IN THE PRESENCE OF AN AGENT OR OFFI-
    18  CER OF THE U.S. IMMIGRATION AND CUSTOMS ENFORCEMENT OR OF U.S.   CUSTOMS
    19  AND BOARDER PROTECTION WHO IS PERFORMING IMMIGRATION-RELATED DUTIES.
    20    2.  THE  POLICE DEPARTMENT SHALL PRESERVE RECORDINGS OF SUCH BODY-WORN
    21  CAMERAS AND PERFORM ALL UPKEEP  ON  EQUIPMENT  USED  IN  SUCH  BODY-WORN
    22  CAMERAS. SUCH DUTIES SHALL INCLUDE:
    23    (A)  CREATING A SECURE RECORD OF ALL INSTANCES WHERE THERE IS RECORDED
    24  VIDEO OR AUDIO FOOTAGE;

     1    (B) ENSURING  OFFICERS  HAVE  SUFFICIENT  STORAGE  CAPACITY  ON  THEIR
     2  CAMERAS  TO  ALLOW  FOR  THE  RECORDING OF INTERACTIONS REQUIRED BY THIS
     3  SECTION; AND
     4    (C) ENSURING OFFICERS HAVE ACCESS TO BODY-WORN CAMERAS FOR THE RECORD-
     5  ING OF INSTANCES REQUIRED BY THIS SECTION.
     6    § 3. This act shall take effect immediately.
