        AN  ACT  to  amend the education law, in relation to requiring an annual
          report on the New York state college choice  tuition  savings  program
          and  the translation of vital documents in the most common non-English
          languages

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. Section 695-c of the education law is amended by adding two
     2  new subdivisions 3 and 4 to read as follows:
     3    3.  COMMENCING  ONE  YEAR AFTER THE EFFECTIVE DATE OF THIS SUBDIVISION
     4  AND ANNUALLY THEREAFTER,  THE  COMPTROLLER,  IN  CONSULTATION  WITH  THE
     5  CORPORATION,  SHALL  SUBMIT  A REPORT ON THE PROGRAM TO THE GOVERNOR AND
     6  THE LEGISLATURE AND SHALL MAKE SUCH REPORT  PUBLICLY  AVAILABLE  ON  THE
     7  COMPTROLLER'S  WEBSITE.  SUCH  ANNUAL  REPORT  SHALL INCLUDE, BUT NOT BE
     8  LIMITED TO, THE FOLLOWING:
     9    A. ACCOUNT USAGE RATES IN EACH  CENSUS  TRACT,  SENATE  DISTRICT,  AND
    10  ASSEMBLY  DISTRICT ACROSS THE STATE, WHICH SHALL BE CALCULATED BY DIVID-
    11  ING THE TOTAL NUMBER OF OPEN ACCOUNTS IN A CENSUS TRACT OR  DISTRICT  BY
    12  THE  POPULATION  OF  INDIVIDUALS  UNDER  AGE EIGHTEEN WHO RESIDE IN SUCH
    13  CENSUS TRACT OR DISTRICT BASED ON THE MOST RECENT CENSUS DATA;
    14    B. BARRIERS TO ACCESSING ACCOUNTS UNDER THE PROGRAM;
    15    C. ACTIONS TAKEN AND ACTIONS THAT WILL BE TAKEN TO REMOVE SUCH  BARRI-
    16  ERS AND IMPROVE THE PROGRAM'S EQUITABILITY; AND
    17    D. FINDINGS AND RECOMMENDATIONS OF THE COMPTROLLER AND CORPORATION, AS
    18  WELL AS ANY RECOMMENDATIONS MADE BY CONSULTANTS UNDER CONTRACT OR VOLUN-
    19  TEERING SERVICES TO THE COMPTROLLER OR CORPORATION.
    20    4. THE COMPTROLLER, IN CONSULTATION WITH THE CORPORATION, SHALL TRANS-
    21  LATE  ALL VITAL DOCUMENTS AND INFORMATION RELEVANT TO THE NY 529 COLLEGE
    22  SAVINGS PROGRAM AND THE NY ABLE PROGRAM  PROVIDED  ONLINE  OR  IN  PAPER
    23  FORMAT,  INCLUDING BUT NOT LIMITED TO APPLICATIONS, FORMS, INSTRUCTIONS,
    24  DISCLOSURE BOOKLETS, WEBSITES, AND ANY OTHER ESSENTIAL PUBLIC  DOCUMENTS
    25  OR  INFORMATION  PROVIDED  TO  OR  COMPLETED BY PROGRAM BENEFICIARIES OR
    26  PARTICIPANTS, INTO AT LEAST THE TWELVE MOST COMMON NON-ENGLISH LANGUAGES

     1  SPOKEN BY LIMITED-ENGLISH PROFICIENT INDIVIDUALS IN THE STATE, INCLUDING
     2  THE MOST COMMON NON-ENGLISH LANGUAGES SPOKEN BY LIMITED  ENGLISH  PROFI-
     3  CIENT  INDIVIDUALS  WHO  HAVE  ARRIVED IN THE STATE WITHIN THE LAST FIVE
     4  YEARS,  BASED  ON  AGGREGATE DATA FROM THE MOST RECENT DECENNIAL CENSUS,
     5  AMERICAN COMMUNITY SURVEY,  AND  ANY  ADDITIONAL  SOURCES  THAT  CAPTURE
     6  TRENDS  IN LANGUAGE USE AND LIMITED-ENGLISH PROFICIENCY WITHIN IMMIGRANT
     7  AND REFUGEE POPULATIONS. CLIENT SERVICES SUPPORT  VIA  PHONE  AND  EMAIL
     8  SHOULD  ALSO  BE PROVIDED IN THESE LANGUAGES TO EXISTING AND PROSPECTIVE
     9  CLIENTS.
    10    § 2. This act shall take effect immediately; provided,  however,  that
    11  subdivision 4 of section 695-c of the education law, as added by section
    12  one  of  this act, shall take effect on the ninetieth day after it shall
    13  have become a law.
