          the Committee on Education

        AN ACT to amend the education law, in relation to requiring a review  of
          school safety plans for traffic and transportation issues

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. The education law is amended by adding a new section  409-o
     2  to read as follows:
     3    §  409-O.  SCHOOL SAFETY PLANS. NOTWITHSTANDING ANY OTHER PROVISION OF
     4  LAW TO THE CONTRARY, A  LOCAL  TRANSPORTATION  REGULATORY  AGENCY  SHALL
     5  REVIEW  AND  APPROVE  A  SCHOOL  SAFETY  PLAN PRIOR TO THE ISSUANCE OF A
     6  BUILDING PERMIT FOR A NEW SCHOOL FACILITY OR THE EXPANSION OR RENOVATION
     7  OF AN EXISTING SCHOOL FACILITY. THE SCHOOL SAFETY PLAN SHALL INCLUDE  AN
     8  EVALUATION OF POTENTIAL TRAFFIC AND TRANSPORTATION ISSUES RELATED TO THE
     9  SCHOOL,  AS WELL AS PROPOSED MEASURES TO MITIGATE ANY SAFETY RISKS.  THE
    10  PROVISIONS OF THIS SECTION SHALL NOT APPLY TO A SCHOOL FACILITY THAT  IS
    11  OWNED OR OPERATED BY A SCHOOL DISTRICT.
    12    § 2. This act shall take effect immediately.
