        AN ACT to amend the education law, in relation to allowing certain unli-
          censed  individuals  to  provide  care  to  animals  in the custody or
          possession of an animal shelter

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section  1.  Section  6713 of the education law is amended by adding a
     2  new subdivision 3 to read as follows:
     3    3. AN UNLICENSED PERSON ACTING UNDER DIRECT OR INDIRECT SUPERVISION OF
     4  A VETERINARIAN LICENSED PURSUANT TO THIS ARTICLE  MAY  PROVIDE  CARE  TO
     5  ANIMALS IN THE CUSTODY OR POSSESSION OF AN ANIMAL SHELTER, AS DEFINED IN
     6  SUBDIVISION  SIX  OF  SECTION FOUR HUNDRED TWENTY OF THE AGRICULTURE AND
     7  MARKETS  LAW,  INCLUDING  ANIMALS  SUBJECT  TO  THE  REDEMPTION  PERIODS
     8  PROVIDED  FOR  IN  SECTION  ONE HUNDRED SEVENTEEN OF THE AGRICULTURE AND
     9  MARKETS LAW, PROVIDED THAT:
    10    A. THE INDIVIDUAL IS PERFORMING TASKS IN ACCORDANCE WITH A WRITTEN  OR
    11  VERBAL PROTOCOL PROVIDED BY THE SUPERVISING VETERINARIAN; AND
    12    B. THE SUPERVISING VETERINARIAN HAS DETERMINED THAT THE INDIVIDUAL HAS
    13  RECEIVED SUFFICIENT AND PROPER TRAINING TO PERFORM THOSE SPECIFIC TASKS.
    14    § 2. This act shall take effect immediately.
