        AN ACT to authorize the commissioner of the department of civil  service
          to  reinstate  Daniel  Montalto on the eligible civil service list for
          employment as a police officer in the town of Shawangunk

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section  1.  Notwithstanding  the provision of section 58 of the civil
     2  service law or any other  provision  of  law  to  the  contrary,  Daniel
     3  Montalto,  who was eligible to sit for the civil service exam for police
     4  officers on December 4, 2004, and  was  eligible  for  employment  as  a
     5  police  officer  for  the town of Hyde Park, New York, at that time, and
     6  who took and passed said exam  on  December  4,  2004,  and  whose  name
     7  appeared  on  the  next civil service eligible list, and who served as a
     8  police officer in the town of Hyde Park, New York from 2005 to 2019, and
     9  who is now forty-three years of age and no longer  deemed  eligible  for
    10  employment  as a police officer due to the 35-year maximum age limit for
    11  police officers pursuant to section 58 of the civil service  law,  shall
    12  be  exempt from said thirty-five year old maximum age limit and shall be
    13  eligible for employment as a police officer in the town  of  Shawangunk,
    14  New  York.  Daniel  Montalto shall otherwise be subject to the merit and
    15  fitness provisions of the civil service  laws  applicable  to  full-time
    16  police officers.
    17    §  2.  The commissioner of the department of civil service shall rein-
    18  state Daniel Montalto on the eligible civil service list,  without  lost
    19  rank  or seniority, provided Mr. Montalto files a request to that effect
    20  with the state comptroller by January 1, 2027.   Any such  reinstatement
    21  shall be effective immediately.
    22    § 3.  This act shall take effect immediately.
