        AN  ACT  to amend the workers' compensation law, in relation to defining
          mental health practitioners with diagnostic authority

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section  1. Subdivision 1 of section 13-b of the workers' compensation
     2  law is amended by adding a new paragraph (r) to read as follows:
     3    (R) "MENTAL HEALTH PRACTITIONER" SHALL  MEAN  AN  INDIVIDUAL  LICENSED
     4  PURSUANT TO ARTICLE ONE HUNDRED SIXTY-THREE OF THE EDUCATION LAW WHO HAS
     5  MET  THE  REQUIREMENTS  FOR  DIAGNOSTIC  PRIVILEGE  SET FORTH IN SECTION
     6  EIGHTY-FOUR HUNDRED ONE-A OF THE EDUCATION LAW.
     7    § 2. This act shall take effect immediately.
