        AN ACT to amend the  town  law,  in  relation  to  requiring  a  special
          election to fill a vacant supervisor position in certain towns

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. The town law is amended by adding a new section 89 to  read
     2  as follows:
     3    §  89. SPECIAL ELECTIONS FOR SUPERVISORS IN TOWNS WITH A POPULATION OF
     4  TWO HUNDRED FIFTY THOUSAND OR MORE.  NOTWITHSTANDING SUBDIVISION FIVE OF
     5  SECTION SIXTY-FOUR OF THIS CHAPTER OR ANY OTHER LAW TO THE CONTRARY,  IN
     6  A  TOWN WITH A POPULATION OF TWO HUNDRED FIFTY THOUSAND OR MORE, WHERE A
     7  SUPERVISOR HAS VACATED SUCH POSITION BEFORE THE END OF THEIR TERM, THERE
     8  SHALL BE A SPECIAL ELECTION HELD TO  FILL  SUCH  VACANCY.  SUCH  SPECIAL
     9  ELECTION SHALL BE HELD ON A TUESDAY AS SOON AS PRACTICABLE.
    10    § 2. This act shall take effect immediately.
