          tee on Insurance

        AN  ACT  to  amend the insurance law, in relation to health care payment
          amounts

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section  1. Section 3224-a of the insurance law is amended by adding a
     2  new subsection (m) to read as follows:
     3    (M)(1) ANY INSURANCE COMPANY WHICH OWNS A HEALTH CARE  PROVIDER,  MUST
     4  PAY THE HEALTH CARE PROVIDER IT OWNS NO MORE THAN THE LOWEST AMOUNT PAID
     5  TO ANY OTHER INSURED HEALTH CARE PROVIDER FOR A COMPARABLE SERVICE.
     6    (2)  ANY  INSURANCE COMPANY, WHICH IS OWNED BY A HEALTH CARE PROVIDER,
     7  MAY NOT PAY THE HEALTH CARE PROVIDER WHICH OWNS  THE  INSURANCE  COMPANY
     8  MORE  THAN  IT  PAYS  THE LOWEST AMOUNT PAID TO ANY OTHER INSURED HEALTH
     9  CARE PROVIDER FOR A COMPARABLE SERVICE.
    10    § 2.  This act shall take effect on the sixtieth day  after  it  shall
    11  have become a law.
