        AN  ACT to amend the vehicle and traffic law, in relation to manufactur-
          ers providing bicycles with electric assist and electric scooters with
          lights

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section  1.  Section 1242 of the vehicle and traffic law is amended by
     2  adding a new subdivision 14 to read as follows:
     3    14. NO MANUFACTURER ENGAGED IN THE BUSINESS OF SHIPPING BICYCLES  WITH
     4  ELECTRIC  ASSIST  IN NEW YORK STATE SHALL SHIP ANY BICYCLE WITH ELECTRIC
     5  ASSIST UNLESS SUCH BICYCLE WITH ELECTRIC ASSIST HAS PERMANENTLY  AFFIXED
     6  THERETO,  A  LAMP  ON  THE  FRONT WHICH SHALL EMIT A WHITE LIGHT VISIBLE
     7  DURING HOURS OF DARKNESS FROM A DISTANCE OF AT LEAST FIVE  HUNDRED  FEET
     8  TO THE FRONT AND WITH A RED OR AMBER LIGHT VISIBLE TO THE REAR FOR THREE
     9  HUNDRED  FEET.  AT  LEAST  ONE  OF  SUCH LIGHTS SHALL BE VISIBLE FOR TWO
    10  HUNDRED FEET FROM EACH SIDE.
    11    § 2. Section 1285 of the vehicle and traffic law is amended by  adding
    12  a new subdivision 4 to read as follows:
    13    4.  NO  MANUFACTURER OF ELECTRIC SCOOTERS SHALL SHIP ANY SUCH ELECTRIC
    14  SCOOTERS IN NEW YORK STATE THAT ARE NOT EQUIPPED WITH  A  LAMP  AND  RED
    15  LIGHT AS REQUIRED UNDER SUBDIVISION ONE OF THIS SECTION.
    16    §  3.  This  act shall take effect on the ninetieth day after it shall
    17  have become a law.
