        AN  ACT to amend the general business law, in relation to requiring that
          all motor vehicles sold at motor vehicle dealerships contain  a  spare
          tire

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. The general business law is amended by adding a new section
     2  396-pp to read as follows:
     3    § 396-PP. SPARE TIRE REQUIREMENT. 1. ALL NEW AND USED  MOTOR  VEHICLES
     4  SOLD  AT MOTOR VEHICLE DEALERSHIPS SHALL INCLUDE A SPARE TIRE COMPATIBLE
     5  WITH THE MOTOR VEHICLE SOLD WHICH IS AT LEAST A DONUT TIRE.  SUCH  SPARE
     6  TIRE  SHALL  BE  PROPERLY  SECURED TO THE MOTOR VEHICLE IN A MANNER THAT
     7  PREVENTS ANY DAMAGE TO THE MOTOR VEHICLE.
     8    2. FOR THE PURPOSES OF THIS SECTION, A "DONUT  TIRE"  IS  A  TEMPORARY
     9  SMALLER  SIZED SPARE TIRE THAT SHOULD ONLY BE USED TEMPORARILY, ALLOWING
    10  THE VEHICLE TO CONTINUE TO BE  DRIVEN  AT  REDUCED  SPEEDS  FOR  LIMITED
    11  DISTANCES.
    12    § 2. This act shall take effect immediately.
