          tee on Racing and Wagering

        AN ACT to amend the racing, pari-mutuel wagering and  breeding  law,  in
          relation  to  mechanisms authorized sports bettors may utilize to fund
          their mobile sports wagering accounts

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section  1.  Paragraph  (b)  of subdivision 5 of section 1367-a of the
     2  racing, pari-mutuel wagering and breeding law, as added by section 4  of
     3  part Y of chapter 59 of the laws of 2021, is amended to read as follows:
     4    (b)  Authorized  sports  bettors may deposit and withdraw funds to and
     5  from their account on a mobile sports wagering operator  through  [elec-
     6  tronically  recognized  payment  methods,  including  but not limited to
     7  credit cards and debit cards, or via any other  means  approved  by  the
     8  commission;  provided however, that in the case of credit card payments,
     9  each authorized sports bettor's account per operator shall be limited to
    10  a credit card spending amount of two thousand five hundred  dollars  per
    11  year;  and  provided  further,  that  this limitation shall not apply to
    12  other payment methods or to debit cards] THE  FOLLOWING  MECHANISMS:  AN
    13  AUTOMATED  CLEARING HOUSE OR ELECTRONIC FUNDS TRANSFER FROM SUCH AUTHOR-
    14  IZED SPORTS BETTOR'S PERSONAL BANK ACCOUNT, A WIRE  TRANSFER  FROM  SUCH
    15  AUTHORIZED  SPORTS  BETTOR'S  PERSONAL  BANK  ACCOUNT,  A PERSONAL CHECK
    16  DELIVERED TO THE OPERATOR, OR AN IN-PERSON CASH DEPOSIT AT A  CASINO  OR
    17  OTHER  LOCATION,  WITH THE APPROVAL OF THE COMMISSION. No operator shall
    18  be authorized to provide a line  of  credit  to  any  authorized  sports
    19  bettor.
    20    § 2. This act shall take effect immediately.
