        Introduced  by  Sen.  CLEARE -- read twice and ordered printed, and when
          printed to be committed to the Committee on Investigations and Govern-
          ment Operations

        AN ACT to amend the cannabis law,  in  relation  to  special  provisions
          applying to applications for an adult-use retail dispensary license in
          a city having a population of one million people or more

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. The cannabis law is amended by adding a new section 61-a to
     2  read as follows:
     3    § 61-A. SPECIAL PROVISIONS APPLYING TO APPLICATIONS FOR  AN  ADULT-USE
     4  RETAIL  DISPENSARY  LICENSE IN A CITY HAVING A POPULATION OF ONE MILLION
     5  PEOPLE OR MORE. IN MAKING THE DECISION TO APPROVE OR DENY  AN  ADULT-USE
     6  RETAIL  DISPENSARY  LICENSE IN A CITY HAVING A POPULATION OF ONE MILLION
     7  PEOPLE OR MORE, THE CANNABIS CONTROL BOARD SHALL:
     8    1. REVIEW THE FIVE MOST RECENT  YEARS  OF  RELEVANT  NEW  YORK  POLICE
     9  DEPARTMENT  CRIME  STATISTICS  FROM THE PRECINCT WHEREIN THE PREMISES OF
    10  THE PROPOSED DISPENSARY IS LOCATED.
    11    2. REVIEW AND TREAT AS BINDING THE FINDING OF ANY RESOLUTION PASSED BY
    12  THE COMMUNITY BOARD WHEREIN THE PREMISES OF THE PROPOSED  DISPENSARY  IS
    13  LOCATED.
    14    § 2. This act shall take effect immediately.
