        Introduced  by  Sen. SERRANO -- read twice and ordered printed, and when
          printed to be committed to the Committee on Finance

        AN ACT to amend the arts and cultural affairs law, in relation to enact-
          ing the visiting artists act; making an  appropriation  therefor;  and
          providing for the repeal of such provisions upon expiration thereof

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. Short title. This act shall be known and may  be  cited  as
     2  the "visiting artists act".
     3    §  2.  Section 3.05 of the arts and cultural affairs law is amended by
     4  adding a new subdivision 12 to read as follows:
     5    12. TO ESTABLISH AND ADMINISTER A GRANT PILOT PROGRAM FOR MUSICIANS TO
     6  PERFORM AT SCHOOLS IN THE STATE WHICH RECEIVE FUNDING PURSUANT TO  TITLE
     7  ONE  OF  THE ELEMENTARY AND SECONDARY EDUCATION ACT (20 U.S.C. § 6301 ET
     8  SEQ.), HEREINAFTER  "ELIGIBLE  SCHOOLS",  UTILIZING  FUNDS  APPROPRIATED
     9  THEREFOR.  GRANTS  SHALL BE AWARDED ON A FIRST COME, FIRST SERVED BASIS,
    10  UP TO A MAXIMUM OF FIVE THOUSAND DOLLARS, TO APPLYING ELIGIBLE  SCHOOLS.
    11  EACH ELIGIBLE SCHOOL MAY BE AWARDED ONE GRANT PER ACADEMIC YEAR.
    12    §  3. The sum of five million dollars ($5,000,000), or so much thereof
    13  as may be necessary, is hereby appropriated to the council on  the  arts
    14  out  of any moneys in the state treasury in the general fund, not other-
    15  wise appropriated, and made immediately available, for  the  purpose  of
    16  carrying out the provisions of this act. Such moneys shall be payable on
    17  the  audit  and  warrant  of  the  comptroller  on vouchers certified or
    18  approved by the  chair  of  the  council  on  the  arts  in  the  manner
    19  prescribed by law.
    20    §  4. This act shall take effect April 1, 2027 and shall expire and be
    21  deemed repealed 2 years after such date.
