        AN ACT to amend the village law and the public officers law, in relation
          to residency requirements for police officers in the village of Medina

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. Section 3-300 of the village law is amended by adding a new
     2  subdivision 37 to read as follows:
     3    37. NOTWITHSTANDING SUBDIVISION ONE OF THIS SECTION, IN THE VILLAGE OF
     4  MEDINA, IN THE COUNTY OF ORLEANS, THE PROVISIONS OF THIS SECTION REQUIR-
     5  ING  A PERSON TO BE A RESIDENT OF THE POLITICAL SUBDIVISION OR MUNICIPAL
     6  CORPORATION OF THE STATE FOR WHICH SUCH PERSON SHALL BE CHOSEN OR WITHIN
     7  WHICH SUCH PERSON'S OFFICIAL FUNCTIONS ARE  REQUIRED  TO  BE  EXERCISED,
     8  SHALL  NOT  PREVENT A PERSON FROM HOLDING THE POSITION OF POLICE OFFICER
     9  FOR THE VILLAGE OF MEDINA, PROVIDED THAT  SUCH  PERSON  RESIDES  IN  THE
    10  COUNTY  OF  ORLEANS,  ANY  CONTIGUOUS  COUNTY,  OR  THE COUNTY OF WAYNE.
    11  PROVIDED, HOWEVER, THE PERSON PERFORMING THE FUNCTIONS OF POLICE OFFICER
    12  IN ANY OTHER VILLAGE SHALL BE A RESIDENT OF SUCH VILLAGE  UNLESS  OTHER-
    13  WISE PROVIDED BY AN ACT OF THE STATE LEGISLATURE.
    14    §  2.  Section 3 of the public officers law is amended by adding a new
    15  subdivision 77 to read as follows:
    16    77. IN THE VILLAGE OF MEDINA, IN THE COUNTY OF ORLEANS, THE PROVISIONS
    17  OF THIS SECTION REQUIRING A PERSON TO BE A  RESIDENT  OF  THE  POLITICAL
    18  SUBDIVISION  OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH SUCH PERSON
    19  SHALL BE CHOSEN OR WITHIN WHICH SUCH  PERSON'S  OFFICIAL  FUNCTIONS  ARE
    20  REQUIRED  TO  BE EXERCISED, SHALL NOT PREVENT A PERSON FROM ACCEPTING OR
    21  RETAINING APPOINTMENT AS A POLICE OFFICER  OF  THE  VILLAGE  OF  MEDINA,
    22  PROVIDED THAT SUCH PERSON RESIDES IN THE COUNTY OF ORLEANS, AN ADJOINING
    23  COUNTY  WITHIN  THE STATE OF NEW YORK, OR THE COUNTY OF WAYNE. PROVIDED,
    24  HOWEVER, THE PERSONS PERFORMING THE FUNCTIONS OF POLICE OFFICER  IN  ANY
    25  OTHER  VILLAGE  SHALL  BE  A  RESIDENT OF SUCH VILLAGE, UNLESS OTHERWISE
    26  PROVIDED BY LAW.
    27    § 3. This act shall take effect immediately.
