        Introduced  by  Sen.  RHOADS -- read twice and ordered printed, and when
          printed to be committed to the Committee on Civil Service and Pensions

        AN ACT to authorize Michael Kilbride to receive an accidental disability
          retirement

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section  1.  Notwithstanding  any  other  provision  of  law,  Michael
     2  Kilbride, who was employed by the office of  court  administration  from
     3  November 28, 1994 until July 28, 2009, and who was critically injured in
     4  January  14,  2009 as a result of an injury on the job and was unable to
     5  return to work, and who was denied an accidental  disability  retirement
     6  from  the New York state and local retirement system, and who, as of the
     7  effective date of this act, is on regular service disability or  receiv-
     8  ing  an ordinary disability benefit, shall be entitled to reapply for an
     9  accidental disability retirement from  the  New  York  state  and  local
    10  retirement system if, within one year of the effective date of this act,
    11  he shall file a written request with the state comptroller.
    12    § 2. This act shall take effect immediately.
