        AN  ACT  to  amend the education law, in relation to expanding the defi-
          nition of professional misconduct

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section  1.  Section  6509 of the education law is amended by adding a
     2  new subdivision 6-a to read as follows:
     3    (6-A) REFUSING TO PROVIDE PROFESSIONAL SERVICES TO A  PERSON  REFERRED
     4  FOR TREATMENT BY A UNITED STATES DEPARTMENT OF VETERANS AFFAIRS FACILITY
     5  OR  PROVIDER  BECAUSE  SUCH PERSON DECLINES ELECTIVE SERVICES DURING THE
     6  COURSE OF TREATMENT, PROVIDED THE DECLINATION DOES NOT RENDER  TREATMENT
     7  MEDICALLY UNSAFE OR VIOLATE PROFESSIONAL STANDARDS OF CARE,
     8    § 2. This act shall take effect immediately
