AN ACT to amend the penal law, in relation to criminal possession of
stolen property in the third, second and first degrees
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. Section 165.50 of the penal law, as amended by chapter 515
2 of the laws of 1986, is amended to read as follows:
3 § 165.50 Criminal possession of stolen property in the third degree.
4 A person is guilty of criminal possession of stolen property in the
5 third degree when [he] SUCH PERSON knowingly possesses stolen property,
6 with intent to benefit [himself] THEMSELF or a person other than an
7 owner thereof or to impede the recovery by an owner thereof, and when:
8 1. the value of the property exceeds three thousand dollars; OR
9 2. REGARDLESS OF THE VALUE OF SUCH PROPERTY, SUCH PROPERTY IS COMMER-
10 CIAL PROPERTY.
11 Criminal possession of stolen property in the third degree is a class
12 D felony.
13 § 2. Section 165.52 of the penal law, as added by chapter 515 of the
14 laws of 1986, is amended to read as follows:
15 § 165.52 Criminal possession of stolen property in the second degree.
16 A person is guilty of criminal possession of stolen property in the
17 second degree when [he] SUCH PERSON knowingly possesses stolen property,
18 with intent to benefit [himself] THEMSELF or a person other than an
19 owner thereof or to impede the recovery by an owner thereof, and when:
20 1. the value of the property exceeds fifty thousand dollars; OR
21 2. REGARDLESS OF THE VALUE OF SUCH PROPERTY, SUCH PROPERTY IS (A) ONE
22 RESIDENTIAL REAL PROPERTY, AS DEFINED BY SECTION 187.00 OF THIS PART;
23 (B) ONE COMMERCIAL PROPERTY THAT IS MIXED-USE PROPERTY WITH AT LEAST
24 ONE RESIDENTIAL UNIT; OR
25 (C) TWO OR MORE COMMERCIAL PROPERTIES.
26 Criminal possession of stolen property in the second degree is a class
27 C felony.

2 laws of 1986, is amended to read as follows:
3 § 165.54 Criminal possession of stolen property in the first degree.
4 A person is guilty of criminal possession of stolen property in the
5 first degree when [he] SUCH PERSON knowingly possesses stolen property,
6 with intent to benefit [himself] THEMSELF or a person other than an
7 owner thereof or to impede the recovery by an owner, and when:
8 1. the value of the property exceeds one million dollars; OR
9 2. REGARDLESS OF THE VALUE OF SUCH PROPERTY, SUCH PROPERTY IS (A)
10 RESIDENTIAL REAL PROPERTY, AS DEFINED BY SECTION 187.00 OF THIS PART,
11 THAT IS OCCUPIED AS A HOME BY AT LEAST ONE PERSON;
12 (B) RESIDENTIAL REAL PROPERTY, AS DEFINED BY SECTION 187.00 OF THIS
13 PART, THAT IS OWNED BY AN ELDERLY PERSON, AN INCOMPETENT, AN INCAPACI-
14 TATED PERSON, OR A PHYSICALLY DISABLED PERSON; OR
15 (C) THREE OR MORE RESIDENTIAL REAL PROPERTIES, AS DEFINED BY SECTION
16 187.00 OF THIS PART.
17 Criminal possession of stolen property in the first degree is a class
18 B felony.
19 § 4. This act shall take effect on the thirtieth day after it shall
20 have become a law.
