          printed to be committed to the Committee on Environmental Conservation

        AN ACT to amend the  environmental  conservation  law,  in  relation  to
          prohibiting certain restrictions on motor vehicle sales

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. Section 19-0323 of the environmental  conservation  law  is
     2  amended by adding a new subdivision 9 to read as follows:
     3    9.  NOTWITHSTANDING  ANY  PROVISION OF LAW TO THE CONTRARY, NO AGENCY,
     4  DEPARTMENT, OR DIVISION OF STATE GOVERNMENT, OR  A  MUNICIPALITY,  SHALL
     5  REGULATE  OR  RESTRICT  THE  USE OR SALE OF MOTOR VEHICLES BY THE PUBLIC
     6  BASED ON THE ENERGY SOURCE OR  FUEL  USED  TO  POWER  A  MOTOR  VEHICLE,
     7  INCLUDING PROPULSION OR FOR POWERING OTHER FUNCTIONS OF SUCH MOTOR VEHI-
     8  CLE.
     9    § 2. This act shall take effect immediately.
