          printed, and when printed to be committed to the  Committee  on  Crime
          Victims, Crime and Correction

        AN  ACT to amend the correction law, in relation to providing vocational
          training to incarcerated individuals on the installation of solar  hot
          water  systems  for the provision of hot water to correctional facili-
          ties

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section  1.  Subdivision  4  of  section 137 of the correction law, as
     2  amended by chapter 322 of the laws  of  2021,  is  amended  to  read  as
     3  follows:
     4    4.  Whenever there shall be a sufficient number of cells or rooms in a
     5  correctional facility,  each  incarcerated  individual  shall  be  given
     6  sleeping  accommodations  in a separate cell or room, provided, however,
     7  that nothing herein contained shall be construed  so  as  to  limit  the
     8  right  of  the department to utilize dormitory-type accommodations where
     9  necessary or where appropriate to a program of treatment.  TO THE EXTENT
    10  PRACTICABLE, SUCH CELLS, ROOMS  AND  DORMITORIES  SHALL  BE  PLUMBED  TO
    11  PROVIDE INCARCERATED INDIVIDUALS HOT WATER.
    12    § 2. Subdivision 2 of section 171 of the correction law, as amended by
    13  chapter 364 of the laws of 1983, is amended to read as follows:
    14    2.  Such  labor  shall  be either for the purpose of the production of
    15  supplies for said institutions, or  for  the  state,  or  any  political
    16  subdivision  thereof, or for any public institution owned or managed and
    17  controlled by the state, or any political subdivision  thereof;  or  for
    18  the  purpose  of industrial training and instruction, or partly for one,
    19  and partly for the other of such purposes. WHERE PRACTICABLE,  INCARCER-
    20  ATED  INDIVIDUALS SHALL BE PROVIDED VOCATIONAL TRAINING TO INSTALL SOLAR
    21  HOT WATER SYSTEMS TO PROVIDE HOT WATER TO CELLS, ROOMS  AND  DORMITORIES
    22  LACKING  IN  SUCH  AMENITY  PURSUANT  TO SUBDIVISION FOUR OF SECTION ONE
    23  HUNDRED THIRTY-SEVEN OF THIS CHAPTER.
    24    § 3. This act shall take effect on the one hundred eightieth day after
    25  it shall have become a law.
