          printed to be committed to the Committee on Environmental Conservation

        AN ACT to amend the  environmental  conservation  law,  in  relation  to
          establishing a symbol to denote environmental composting

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. The  environmental  conservation  law  is  amended  by  new
     2  section 3-0323 to read as follows:
     3  § 3-0323. COMPOSTING SYMBOL. THE DEPARTMENT SHALL:
     4    1.  DEVELOP  A  SYMBOL  DENOTING A PRODUCT THAT IS ACCEPTABLE IN EVERY
     5  COMPOSTING FACILITY GOVERNED BY THE DEPARTMENT;
     6    2. CREATE A LIST OF CATEGORIES OF PRODUCTS THAT SHALL BEAR THE  SYMBOL
     7  PURSUANT  TO  SUBDIVISION ONE OF THIS SECTION, INCLUDING BUT NOT LIMITED
     8  TO SINGLE-USE FOOD CONTAINERS, UTENSILS, AND WRAPPERS,  AND  COMPOSTABLE
     9  PLASTICS (NOT BIODEGRADABLE, AS DIFFERENTIATED FROM COMPOSTABLE); AND
    10    3.  PROMULGATE RULES AND REGULATIONS FOR THE IMPLEMENTATION OF, AND TO
    11  DETERMINE PENALTIES FOR NON-COMPLIANCE WITH THIS SECTION.
    12    § 2. This act shall take effect immediately.
