          printed to be committed to the Committee on Investigations and Govern-
          ment Operations

        AN ACT to amend the alcoholic  beverage  control  law,  in  relation  to
          removing  the  requirement  of  the state liquor authority to have not
          more than two members of the authority belong to  the  same  political
          party

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. Section 11  of  the  alcoholic  beverage  control  law,  as
     2  amended  by  section  2  of part E of chapter 57 of the laws of 2011, is
     3  amended to read as follows:
     4    § 11. Appointment of authority. The members of the authority shall  be
     5  appointed  by  the  governor  by  and with the advice and consent of the
     6  senate. [Not more than two members of the authority shall belong to  the
     7  same political party.] The [chairman] CHAIRPERSON of the state alcoholic
     8  beverage control board heretofore appointed and designated by the gover-
     9  nor  and the remaining members of such board heretofore appointed by the
    10  governor shall continue to serve as [chairman] CHAIRPERSON  and  members
    11  of  the authority until the expiration of the respective terms for which
    12  they were appointed.  Upon the expiration of such respective  terms  the
    13  successors of such [chairman] CHAIRPERSON and members shall be appointed
    14  to  serve for a term of three years each and until their successors have
    15  been appointed and qualified.  The commissioners, other than the [chair-
    16  man] CHAIRPERSON shall, when performing the work of  the  authority,  be
    17  compensated  at  a  rate  of two hundred sixty dollars per day, together
    18  with an allowance for actual and  necessary  expenses  incurred  in  the
    19  discharge  of  their duties. The [chairman] CHAIRPERSON shall receive an
    20  annual salary established in section one hundred sixty-nine of the exec-
    21  utive law.
    22    § 2. This act shall take effect immediately.
