        AN ACT to amend the New York city health and hospitals corporation  act,
          in  relation  to requiring compliance with the city's uniform land use
          review procedure for the disposition  of  land  or  buildings  by  the
          corporation

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. Subdivision 6 of section 5 of section 1 of chapter 1016  of
     2  the  laws  of  1969, constituting the New York city health and hospitals
     3  corporation act, is amended to read as follows:
     4    6. To acquire, by purchase, gift, devise, lease or  sublease,  and  to
     5  accept  jurisdiction  over  and to hold and own, and dispose of by sale,
     6  lease or sublease, real or personal property, including but not  limited
     7  to  a  health  facility,  or  any  interest  therein  for  its corporate
     8  purposes; provided, however, that no health facility or other real prop-
     9  erty acquired or constructed by the corporation shall be sold, leased or
    10  otherwise transferred by the corporation without [public hearing by  the
    11  corporation  after  twenty days public notice and without the consent of
    12  the board of estimate of the city]  FOLLOWING  AND  COMPLYING  WITH  THE
    13  PROVISIONS OF THE CITY'S UNIFORM LAND USE REVIEW PROCEDURE;
    14    §  2.  Subdivision  4 of section 7 of section 1 of chapter 1016 of the
    15  laws of 1969, constituting the New York city health and hospitals corpo-
    16  ration act, is amended to read as follows:
    17    4. If the corporation determines that the use  and  occupancy  of  any
    18  real  property  is  no  longer  required  for its corporate purposes and
    19  powers, then if such real property was acquired at the cost and  expense
    20  of the city, the corporation shall, subject to the provisions of section
    21  five,  paragraph  six,  have power to surrender its use and occupancy to
    22  the city. The corporation shall, subject to the  provisions  of  section
    23  five,  paragraph  six, have power to sell, lease or otherwise dispose of

     1  said real property at public or private sale or as part of  a  contract,
     2  lease or other agreement entered into under the terms of this act and to
     3  use the proceeds derived from the sale, lease or other disposition ther-
     4  eof  for  its corporate purposes. NOTWITHSTANDING ANY LAW, RULE OR REGU-
     5  LATION TO THE CONTRARY, ANY DISPOSITION OF  LAND  OR  BUILDINGS  BY  THE
     6  CORPORATION  SHALL BE SUBJECT TO AND SHALL COMPLY WITH THE PROVISIONS OF
     7  THE CITY'S UNIFORM LAND USE REVIEW PROCEDURE.
     8    § 3. This act shall take effect on the one hundred eightieth day after
     9  it shall have become a law.
