        Introduced  by Sen. HARCKHAM -- read twice and ordered printed, and when
          printed to be committed to the Committee on Investigations and Govern-
          ment Operations

        AN ACT to amend the alcoholic  beverage  control  law,  in  relation  to
          providing the village of Ossining, Westchester county, with the abili-
          ty  to set restrictions on the hours of sale of alcoholic beverages at
          retail for on-premises consumption

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section  1.  Section  106  of  the  alcoholic  beverage control law is
     2  amended by adding a new subdivision 5-a to read as follows:
     3    5-A. NOTWITHSTANDING ANY PROVISION OF LAW, RULE OR REGULATION  TO  THE
     4  CONTRARY,  THE  PROVISIONS OF SUBDIVISION FIVE OF THIS SECTION SHALL NOT
     5  BE CONSTRUED TO PROHIBIT THE VILLAGE OF  OSSINING,  WESTCHESTER  COUNTY,
     6  FROM IMPOSING RESTRICTIONS ON THE HOURS ALCOHOLIC BEVERAGES MAY BE SOLD,
     7  OFFERED  FOR SALE OR GIVEN AWAY UPON ANY PREMISES LICENSED TO SELL ALCO-
     8  HOLIC BEVERAGES AT RETAIL FOR  ON-PREMISES  CONSUMPTION  BY  LOCAL  LAW,
     9  ORDINANCE,  OR RESOLUTION WHICH ARE MORE RESTRICTIVE THAN THE PROVISIONS
    10  SET FORTH IN SUCH SUBDIVISION.
    11    § 2. This act shall take effect on the thirtieth day  after  it  shall
    12  have become a law.
