        Introduced  by  Sen. WALCZYK -- read twice and ordered printed, and when
          printed to be committed to the Committee on  Energy  and  Telecommuni-
          cations

        AN  ACT  to amend the public service law, in relation to prohibiting the
          imposition of a system benefits charge on ratepayers' utility bills

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section  1.  The public service law is amended by adding a new section
     2  18 to read as follows:
     3    § 18. PROHIBITION ON SYSTEM BENEFITS CHARGE.  THE COMMISSION SHALL  BE
     4  PROHIBITED FROM IMPOSING ON RATEPAYERS' UTILITY BILLS A SURCHARGE OF THE
     5  KIND  DESIGNATED  BY THE COMMISSION AT THE TIME OF THE EFFECTIVE DATE OF
     6  THIS SECTION AS A SYSTEM BENEFITS CHARGE.
     7    § 2. This act shall take effect immediately.
