        Introduced  by Sen. HARCKHAM -- read twice and ordered printed, and when
          printed to be committed to the Committee on Investigations and Govern-
          ment Operations

        AN ACT to amend the public officers law,  in  relation  to  waiving  the
          residency requirement for the commissioner of health and public health
          director for Putnam county

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. Section 3 of the public officers law is amended by adding a
     2  new subdivision 76 to read as follows:
     3    76. IN THE COUNTY OF PUTNAM, THE PROVISIONS OF THIS SECTION  REQUIRING
     4  A  PERSON  TO  BE  A  RESIDENT OF THE POLITICAL SUBDIVISION OR MUNICIPAL
     5  CORPORATION OF THE STATE FOR WHICH SUCH PERSON SHALL BE CHOSEN OR WITHIN
     6  WHICH SUCH PERSON'S OFFICIAL FUNCTIONS ARE  REQUIRED  TO  BE  EXERCISED,
     7  SHALL  NOT  PREVENT  A PERSON FROM HOLDING THE OFFICE OF COMMISSIONER OF
     8  HEALTH AND THE PUBLIC HEALTH DIRECTOR OF THE COUNTY OF PUTNAM,  PROVIDED
     9  THAT  SUCH PERSON RESIDES IN PUTNAM COUNTY OR AN ADJOINING COUNTY WITHIN
    10  THE STATE OF NEW YORK; PROVIDED, HOWEVER THAT ANY PERSON PERFORMING SUCH
    11  FUNCTIONS OR HOLDING THE OFFICE OF COMMISSIONER  OF  HEALTH  AND  PUBLIC
    12  HEALTH  DIRECTOR  IN ANY OTHER COUNTY SHALL BE A RESIDENT OF SUCH COUNTY
    13  UNLESS OTHERWISE PROVIDED BY LAW.
    14    § 2. This act shall take effect immediately.
