          printed to be committed to the Committee on  Energy  and  Telecommuni-
          cations

        AN  ACT  to  amend the public service law, in relation to establishing a
          usage monitor program

          THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. Section 44 of the public service law is amended by adding a
     2  new subdivision 8 to read as follows:
     3    8.  THE COMMISSION SHALL REQUIRE EVERY GAS AND ELECTRIC UTILITY CORPO-
     4  RATION UTILIZING SMART METERS TO ESTABLISH A USAGE MONITOR  PROGRAM  FOR
     5  THE  PURPOSES OF NOTIFYING CUSTOMERS WHEN ENERGY USAGE EXCEEDS A COST OR
     6  USAGE THRESHOLD IN A GIVEN BILLING PERIOD DETERMINED  BY  THE  CUSTOMER.
     7  THE  USAGE  MONITOR PROGRAM SHALL PROVIDE CUSTOMERS WITH A NOTICE ON THE
     8  TENTH AND TWENTIETH DAY OF A BILLING CYCLE. THE  USAGE  MONITOR  PROGRAM
     9  SHALL NOTIFY CUSTOMERS ELECTRONICALLY OR BY MAIL WHEN THEIR ENERGY USAGE
    10  EXCEEDS  THEIR  DETERMINED  THRESHOLD  AND  INCLUDE AN ESTIMATE OF THEIR
    11  MONTHLY BILL. THE USAGE MONITOR PROGRAM SHALL BE AN ELECTIVE PROGRAM FOR
    12  CUSTOMERS TO JOIN. FOR THE PURPOSES OF THIS SUBDIVISION,  "SMART  METER"
    13  SHALL MEAN A METERING DEVICE THAT MEASURES AND TRANSMITS ENERGY USAGE TO
    14  A UTILITY FOR THE PURPOSES OF BILLING AND MONITORING.
    15    §  2  This act shall take effect one year after it shall have become a
    16  law.
