          printed to be committed to the Committee on Rules

        AN ACT to amend the alcoholic  beverage  control  law,  in  relation  to
          creating a special on-premises license for certain properties

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. The alcoholic beverage control law is amended by  adding  a
     2  new section 97-e to read as follows:
     3    §  97-E.  SPECIAL  ON-PREMISES  LICENSE  FOR  CERTAIN  PROPERTIES.  1.
     4  NOTWITHSTANDING ANY PROVISIONS OF LAW TO THE CONTRARY,  ANY  PERSON  MAY
     5  APPLY  TO THE LIQUOR AUTHORITY FOR A LICENSE TO SELL LIQUOR, WINE, BEER,
     6  AND CIDER AT RETAIL FOR ON-PREMISES CONSUMPTION AT A FACILITY WHICH:
     7    (A) IS LOCATED WITHIN  A  DESIGNATED  INDUSTRIAL  OR  ECONOMIC  ZONING
     8  DISTRICT;
     9    (B) OCCUPIES NOT LESS THAN TWENTY THOUSAND SQUARE FEET OF FLOOR AREA;
    10    (C)  IS UTILIZED FOR THE PURPOSE OF HOSTING ENTERTAINMENT OR CULTURAL,
    11  SOCIAL, OR COMMUNITY EVENTS; AND
    12    (D) IS LOCATED AT LEAST FIVE HUNDRED FEET FROM A RESIDENTIAL BUILDING.
    13    2. ANY LICENSE ISSUED PURSUANT TO THIS SECTION SHALL BE SUBJECT TO ALL
    14  PROVISIONS OF THIS CHAPTER NOT INCONSISTENT WITH SUBDIVISION ONE OF THIS
    15  SECTION AND MAY BE SUBJECTED TO SUCH RULES BY THE LIQUOR AUTHORITY AS IT
    16  DEEMS NECESSARY AND SUCH RULES AS ARE IN CONFORMITY WITH THE  PROVISIONS
    17  OF SUBDIVISION ONE OF THIS SECTION.
    18    § 2. This act shall take effect immediately.
