          printed to be committed to the Committee on Rules

        AN ACT to amend the public officers law,  in  relation  to  waiving  the
          residency requirement for the St. Lawrence county public health direc-
          tor and community services director

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. Section 3 of the public officers law is amended by adding a
     2  new subdivision 76 to read as follows:
     3    76. IN THE COUNTY OF ST. LAWRENCE,  THE  PROVISIONS  OF  THIS  SECTION
     4  REQUIRING  A  PERSON  TO  BE  A RESIDENT OF THE POLITICAL SUBDIVISION OR
     5  MUNICIPAL CORPORATION OF THE STATE FOR WHICH SUCH PERSON SHALL BE CHOSEN
     6  OR WITHIN WHICH THEIR OFFICIAL FUNCTIONS ARE REQUIRED TO  BE  EXERCISED,
     7  SHALL  NOT  PREVENT  A  PERSON  FROM HOLDING THE OFFICE OF COUNTY PUBLIC
     8  HEALTH DIRECTOR OR DIRECTOR OF COMMUNITY SERVICES OF THE COUNTY  OF  ST.
     9  LAWRENCE,  PROVIDED  THAT  SUCH PERSON RESIDES IN A COUNTY ADJOINING ST.
    10  LAWRENCE COUNTY WITHIN THE STATE OF NEW YORK; PROVIDED, HOWEVER THAT ANY
    11  PERSON PERFORMING SUCH FUNCTIONS OR HOLDING THE OFFICE OF COUNTY  PUBLIC
    12  HEALTH  DIRECTOR  OR  DIRECTOR OF COMMUNITY SERVICES IN ANY OTHER COUNTY
    13  SHALL BE A RESIDENT OF SUCH COUNTY UNLESS OTHERWISE PROVIDED BY LAW.
    14    § 2. This act shall take effect immediately.
