          printed to be committed to the Committee on Rules

        AN ACT to amend the public  service  law,  in  relation  to  denials  of
          increased utility rates and charges

          THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
        BLY, DO ENACT AS FOLLOWS:

     1    Section 1. Subdivision 12 of section 66 of the public service  law  is
     2  amended by adding a new paragraph (m) to read as follows:
     3    (M)  WHENEVER  THE COMMISSION SHALL DENY A REQUEST BY A UTILITY FOR AN
     4  INCREASED RATE OR CHARGE, OR TARIFF,  OR  ANY  CHANGE  IN  ANY  FORM  OF
     5  CONTRACT  OR AGREEMENT OR ANY RULE OR REGULATION RELATING TO ANY RATE OR
     6  CHARGE, OR TARIFF OR SERVICE, OR IN ANY GENERAL PRIVILEGE  OR  FACILITY,
     7  THE  RATE OR CHARGE, OR TARIFF OR SERVICE IMMEDIATELY IN EFFECT PRIOR TO
     8  THE COMMISSION'S DENIAL SHALL REMAIN IN FULL FORCE AND EFFECT UNTIL SUCH
     9  TIME AS THE COMMISSION APPROVES A NEW  RATE  OR  CHARGE,  OR  TARIFF  OR
    10  SERVICE.
    11    § 2. This act shall take effect immediately.
