A BILL TO BE ENTITLED 1
AN ACT REQUIRING THE ATTORNEY GENERAL TO INVESTIGATE INCIDEN TS 2
INVOLVING FEDERAL IM MIGRATION ENFORCEMEN T THAT RESULT IN 3
SERIOUS BODILY INJURY OR DEATH. 4
The General Assembly of North Carolina enacts: 5
SECTION 1. Article 1 of Chapter 114 of the General Statutes is amended by adding 6
a new section to read: 7
"§ 114-8.8. Investigations into incidents involving federal law enforcement. 8
(a) Definitions. – For purposes of this section, the following definitions apply: 9
(1) CBP. – Customs and Border Protection of the United States Department of 10
Homeland Security. 11
(2) Federal immigration enforcement . – Officers, agents, or other personnel 12
employed by CBP or ICE , or any State or local law enforcement officer s or 13
employees authorized to perform immigration officer functions pursuant to 14
section 287(g) of the Immigration and Nationality Act, 8 U.S.C. § 1357. 15
(3) ICE. – Immigration and Customs Enforcement of the United States 16
Department of Homeland Security. 17
(b) Investigations. – The Attorney General shall investigate all incidents occurring in this 18
State that involve federal immigration enforcement and result in serious bodily injury or death to 19
any party. The investigation shall determine the cause and circumstances of the incident. 20
(c) Reports. – The Attorney General shall publicly release all findings and 21
recommendations from any investigation described in subsection (b) of this section and deliver 22
copies of such findings to the Speaker of the House of Representatives and the President Pro 23
Tempore of the Senate within seven days of completing an investigation. The Attorney General 24
may redact the names and personally identifying information o f any victims and minors 25
mentioned in such findings." 26
SECTION 2. There is appropriated from the General Fund to the Department of 27
Justice the sum of four hundred fifty thousand dollars ($450,000) in nonrecurring funds for the 28
2026-2027 fiscal year to be used to implement the requirements of this act. 29
SECTION 3. This act is effective when it becomes law and applies to incidents 30
occurring on or after that date. 31
