A HOUSE RESOLUTION E NCOURAGING CONGRESS TO PRESERVE NORTH 1
CAROLINA'S AUTHORITY TO REGULATE ARTIFIC IAL INTELLIGENCE IN 2
MATTERS RELATED TO C ONSUMER PROTECTION A ND TO OPPOSE FEDERAL 3
MORATORIA THAT WOULD RESTRICT STATES FRO M ENFORCING EXISTING 4
LAWS. 5
Whereas, states have a legitimate interest in and duty to protect their citizens from 6
fraud, price gouging, unfair and deceptive trade practices, and other harmful or abusive 7
commercial practices; and 8
Whereas, artificial intelligence and automated systems are increasingly being used by 9
malicious actors in the commercial space to take unfair advantage of consumers; and 10
Whereas, many states, including North Carolina, have laws providing for consumer 11
protection and such laws should be enforceable and remain within the province of the State to 12
the extent necessary to conform and apply the laws as the circumstances require to address these 13
new systems of abuse; and 14
Whereas, states should proactively continue to monitor the commercial space and take 15
actions against abusive practices in order to protect consumers regardless of the modalities used 16
by malicious actors to prey upon others; and 17
Whereas, North Carolina affirms its authority to enforce consumer protection laws 18
when AI is involved and rejects limitations imposed by federal action where that action material 19
diminishes or compromises the State's duty to protect its citizenry; Now, therefore, 20
Be it resolved by the House of Representatives: 21
SECTION 1. The United States Congress is urged to take any and all necessary steps 22
to continue to allow states to regulate harmful uses of artificial intelligence, to allow State entities 23
to retain full investigative and enforcement authority over such harmful uses, to affirm that states 24
may enact laws addressing consumer harms arising from artificial intelligence usage, and to 25
otherwise preserve North Carolina's authority and duty to investigate, regulate, and enforce laws 26
against harmful and deceptive trade practi ces perpetrated by unlawful actors, regardless of 27
whether those actors use artificial intelligence or more traditional means of subterfuge. 28
SECTION 2. This resolution is effective upon adoption. 29
