A BILL TO BE ENTITLED 1
AN ACT TO ALLOW CERT AIN EDUCATIONAL ORGA NIZATIONS AND STATE 2
AGENCIES TO EXPEDITE THE PROCESS TO OBTA IN SURPLUS AND 3
DECOMMISSIONED FEDERAL MATERIAL AND PROPERTY. 4
The General Assembly of North Carolina enacts: 5
SECTION 1. Part 2 of Article 3A of Chapter 143 of the General Statutes is amended 6
by adding the following new sections to read: 7
"§ 143-64.5A. Certain educational institutions exempt. 8
Notwithstanding any provisions or limitations of this Part, a n educational organi zation is 9
authorized and empowered to obtain decommissioned and surplus material and property under 10
contracts and agreements with the federal government or any of its departments or agencies 11
provided that the material and property is intended to be used fo r educational purposes. For the 12
purposes of this section, the term "educational organization " means an organization that has 13
education as its pr imary purpose and that is a nonprofit organization, a not -for-profit 14
organization, or an organization that has tax-exempt status under 26 U.S.C. § 501(c)(3). 15
"§ 143-64.5B. Public safety exemption. 16
Notwithstanding any provisions or limitations of this Part, any State agency is authorized and 17
empowered to obta in decommissioned and surplus material and property under contracts and 18
agreements with the federal government or any of its departments or agencies provided that the 19
material and property is intended to promote public safety. For the purposes of this sect ion, the 20
term "State agency" means any board, bureau, commission, department, institution, or agency of 21
the State." 22
SECTION 2. This act is effective when it becomes law. 23
