A BILL TO BE ENTITLED 1
AN ACT TO PROHIBIT T HE INTENTIONAL RELEA SE OF POLLUTING EMIS SIONS, 2
INCLUDING STRATOSPHE RIC AEROSOL INJECTIO N, CLOUD SEEDING, AN D 3
ELECTROMAGNETIC RADIO FREQUENCY, INTO TH E ATMOSPHERE TO ALTE R 4
THE TEMPERATURE, WEATHER, OR THE INTENSITY OF SUNLIGHT. 5
The General Assembly of North Carolina enacts: 6
SECTION 1. G.S. 143-213 is amended by adding a new subdivision to read: 7
"(5b) The term "atmospheric modification " means stratospheric aerosol injection 8
(SAI), cloud seeding, electromagnetic radio frequency or microwave radiation 9
emissions, or other atmospheric polluting activity affecting temperature, 10
weather, intensity of sunlight, the environment, agriculture, wild life, human 11
health and safety, aviation, state security, or the economy of the State. The 12
term does not include the application of pesticides via aircraft under a license 13
issued by the Pesticide Board pursuant to Article 52 of this Chapter." 14
SECTION 2. G.S. 143-215.108(a) is amended by adding a new subdivision to read: 15
"(5) Intentionally inject, release, or disperse, by any means, chemicals, chemical 16
compounds, substances, or apparatus within the borders of this State into the 17
atmosphere with the intentional or sole purpose of atmospheric modification." 18
SECTION 3. The Environmental Management Commission shall adopt rules 19
necessary to implement this act. 20
SECTION 4. This act is effective when it becomes law. 21
