AN ACT PROVIDING THA T VETERANS, THEIR DE PENDENTS, AND OTHER 2
COVERED INDIVIDUALS UNDER THE VETERANS A CCESS, CHOICE, AND 3
ACCOUNTABILITY ACT W HO QUALIFY FOR ADMIS SION TO AN INSTITUTI ON 4
OF HIGHER EDUCATION ARE ELIGIBLE TO BE C HARGED IN -STATE TUITION 5
WITHOUT REGARD TO TH E NUMBER OF YEARS TH AT HAVE ELAPSED SINC E 6
THEIR DISCHARGE FROM A PERIOD OF ACTIVE DUTY SERVICE OF NINE TY 7
DAYS OR MORE. 8
The General Assembly of North Carolina enacts: 9
SECTION 1. G.S. 116-143.3A reads as rewritten: 10
"§ 116-143.3A. Waiver of 12-month residency requirement for certain veterans and other 11
individuals. 12

(b) Waiver of 12-Month Residency Requirement for Certain Individuals. – Any veteran, 14
dependent of a veteran, or other "covered" individual under 38 U.S.C. § 3679 ("The Choice Act") 15
who qualifies for admission to an institution of higher education as defined in 16
G.S. 116-143.1(a)(3) is eligible to be charged the in-State tuition rate and applicable mandatory 17
fees for enrollment, to the extent required by 38 U.S.C. § 3679, enrollment without satisfying the 18
12-month residency requirement under G.S. 116-143.1, provided the individual meets all of the 19
following criteria: 20

SECTION 2. This act is effective when it becomes law and applies beginning with 22
the 2025-2026 academic year. 23
