A BILL TO BE ENTITLED 1
AN ACT TO PROVIDE VA RIOUS ADVANCED RECYC LING DEFINITIONS AND 2
PROCEDURES. 3
The General Assembly of North Carolina enacts: 4
SECTION 1.(a) Subdivisions (17a) and (41b) of G.S. 130A-290(a) are recodified as 5
subdivisions (17b) and (41c), respectively, of that subsection. 6
SECTION 1.(b) G.S. 130A-290, as amended by subsection (a) of this section, reads 7
as rewritten: 8
"§ 130A-290. Definitions. 9
(a) Unless a different meaning is required by the context, the following definitions shall 10
apply throughout this Article: 11

(17a) "Mass balance attribution " means an auditable chain of custody accounting 13
methodology pursuant to a third-party certification system that enables the 14
manufacturer to attribute quantities of feedstocks to one or more recycled 15
products. 16

(24a) "Recycled products" or "recycled product" means products that are produced 18
from recyclable material and via mass balance attribution for chemical 19
recycling processes. The designation of a product as a "recycled product" does 20
not exempt the product from otherwis e applicable air, water , or hazardous 21
waste statutory or regulatory requirements. 22

(41b) "Third-party certification system " means an international and multinational 24
third-party certification system that consists of a set of rules for the 25
implementation of mass balance attribution methodologies for the recycling 26
of materials. 27
