A BILL TO BE ENTITLED 1
AN ACT TO LIMIT THE ATTORNEY GENERAL'S P ARTICIPATION IN LITI GATION 2
ADVANCING ANY ARGUME NT THAT WOULD RESULT IN THE INVALIDATION 3
OF ANY EXECUTIVE ORD ER ISSUED BY THE PRE SIDENT OF THE UNITED 4
STATES. 5
The General Assembly of North Carolina enacts: 6
SECTION 1. G.S. 114-2.8, as enacted by Section 3D.1 of S.L. 2024 -57, reads as 7
rewritten: 8
"§ 114-2.8. Limitation on participation in foreign certain litigation. 9
The Attorney General shall not, as a party, amicus, or any other participant in an action 10
pending before a state or federal court in another state, advance any argument that would result 11
in the invalidation of (i) any statute enacted by the General Assembly.Assembly or (ii) any 12
executive order issued by the President of the United States." 13
SECTION 2. This act is effective when it becomes law and applies to actions filed 14
or commenced on or after that date. 15
