A BILL TO BE ENTITLED 1
AN ACT TO REDUCE THE INCREASE IN THE STA TE GENERAL FUND OPER ATING 2
BUDGET BY REDUCING THE STATUTORY CAP ON THE OPERATING BUDGET AS 3
A PERCENTAGE OF TOTAL STATE PERSONAL INCOME TO SIX PERCENT. 4
The General Assembly of North Carolina enacts: 5
SECTION 1. G.S. 143C-4-6 reads as rewritten: 6
"§ 143C-4-6. General Fund operating budget size limited. 7
(a) Size Limitation. – Except as otherwise provided in this section, the General Fund 8
operating budget each fiscal year shall not be greater than seven percent (7%) six percent (6%) 9
of the projected total State personal income for that fiscal year. 10
(a1) Extraordinary Exceedance of Budget Size Limitation. – In each fiscal year, funds in 11
excess of the size limitation set forth in subsection (a) of this section shall be available for 12
expenditure upon a two -thirds vote of the membership of the Senate and the House of 13
Representatives present and voting. 14

SECTION 2. This act becomes effective July 1, 2025, and applies to General Fund 16
operating budgets adopted by the General Assembly on or after that date. 17
