A BILL TO BE ENTITLED 1
AN ACT APPROPRIATING FUNDS TO CREATE AND SUPPORT LOCAL JUDIC IALLY 2
MANAGED ACCOUNTABILITY AND RECOVERY COSTS. 3
The General Assembly of North Carolina enacts: 4
SECTION 1. There is appropriated from the General Fund to the Administrative 5
Office of the Courts the sum of four million two hundred thousand dollars ($4,200,000) in 6
recurring funds beginning in the 2026 -2027 fiscal year to be used to create and sustain local 7
judicially managed accountability and recovery courts authorized by Article 62 of Chapter 7A of 8
the General Statutes, including drug treatment courts and other local judicially managed 9
accountability and recovery courts exempted from the requirements of that A rticle pursuant to 10
G.S. 7A-802. The courts funded by this section shall primarily serve individuals diagnosed with 11
alcoholism or other substance use and dependency disorders that are defendants in the criminal 12
justice system. Among other functions, these c ourts shall recommend treatment plans for 13
individuals served by these courts and shall monitor the progress of the individuals receiving 14
treatment while the individuals remain under the jurisdiction of these courts. 15
SECTION 2. There is appropriated from t he General Fund to the Administrative 16
Office of the Courts the sum of four million two hundred thousand dollars ($4,200,000) in 17
recurring funds beginning in the 2026 -2027 fiscal year to be used to facilitate the creation and 18
funding of new and existing loc al judicially managed accountability and recovery courts 19
authorized by Article 62 of Chapter 7A of the General Statutes, including drug treatment courts 20
and other local judicially managed accountability and recovery courts exempted from the 21
requirements of that Article pursuant to G.S. 7A-802. The courts funded by this section shall 22
primarily serve individuals that have a mental health diagnosis or treatment history and are 23
defendants in the criminal justice system. Among other functions, these courts shall recommend 24
mental health treatment plans for individuals served by these courts and shall monitor the 25
progress of the individuals receiving treatment while the individuals remain under the jurisdiction 26
of these courts. 27
SECTION 3. This act becomes effective July 1, 2026. 28
