AN ACT TO PREVENT TH E ELIMINATION OF RET IREE MEDICAL BENEFIT S FOR 2
MEMBERS FIRST EARNIN G SERVICE ON OR AFTE R JANUARY 1, 2021, U NDER 3
THE NORTH CAROLINA T EACHERS' AND STATE E MPLOYEES' RETIREMENT 4
SYSTEM, THE CONSOLID ATED JUDICIAL RETIREMENT SYSTEM, T HE 5
LEGISLATIVE RETIREME NT SYSTEM, OR THE OP TIONAL RETIREMENT 6
PROGRAMS. 7
The General Assembly of North Carolina enacts: 8
SECTION 1.(a) Subsections (c) and (d) of Section 35.21 of S.L. 2017 -57 are 9
repealed. 10
SECTION 1.(b) This section is effective retroactively to December 31, 2020. 11
SECTION 2. There is appropriated from the General Fund to the Department of 12
State Treasurer the sum of five hundred thousand dollars ($500,000) in recurring funds for the 13
2025-2026 fiscal year and the sum of two million dollars ($2,000,000) in recurring funds for the 14
2026-2027 fiscal year to be used to address the increased cost to the North Carolina State Health 15
Plan for Teachers and State Employees as a result of the continuation of retiree medical members 16
under this act. 17
SECTION 3. Except as otherwise provided, this act becomes effective July 1, 2025. 18
