A BILL TO BE ENTITLED 1
AN ACT TO ALLOW THE MITCHELL COUNTY SHERIFF'S OFFICE AND THE YANCEY 2
COUNTY SHERIFF'S OFF ICE TO ENTER INTO ME MORANDUMS OF 3
UNDERSTANDING WITH THE UNICOI COUNTY, TENNESSEE, SHERIFF'S OFFICE 4
TO PERFORM LAW ENFOR CEMENT SPECIAL OPERA TIONS MISSIONS AND 5
COOPERATIVE LAW ENFORCEMENT ACTIONS ACROSS STATE LINES. 6
The General Assembly of North Carolina enacts: 7
SECTION 1.(a) Notwithstanding any provision of law to the contrary, the Mitchell 8
County Sheriff's Office and the Yancey County Sheriff's Office may enter into memorandums of 9
understanding with the Unicoi County, Tennessee, Sheriff's Office to engage across state lines in 10
law enforcement special operations missions and cooperative law enforcement actions. 11
SECTION 1.(b) Any memorandum of understanding entered into pursuant to this 12
section shall specify the manner in which liability claims for damage to persons or property as a 13
result of law enforcement special operations missions and cooperative law enforcement actions 14
will be shared or assigned. While ensuring public safety, each memorandum of understanding 15
shall limit to the greatest extent possible the liability of Mi tchell County, Yancey County, and 16
the State. 17
SECTION 2. No later than November 1 of each year, any memorandum of 18
understanding entered into that year pursuant to this act shall be reported to the Department of 19
Justice. 20
SECTION 3. This act is effective when it becomes law. 21
