COMMISSIONERS ARE FI LLED IN ACCORDANCE W ITH G.S. 153A-27; TO 3
PROVIDE FOR THE PART ISAN ELECTION FOR ME MBERS OF THE JACKSON 4
COUNTY BOARD OF EDUC ATION; AND TO PROVID E THAT THE CITY OF 5
JACKSONVILLE SHALL E XERCISE PLANNING AND DEVELOPMENT 6
AUTHORITY ONLY WITHIN THE CITY'S CONTIGUOUS CORPORATE LIMITS. 7
The General Assembly of North Carolina enacts: 8

PART I. MODIFY PROCE SS FOR FILLING VACAN CIES ON THE HAYWOOD 10
COUNTY BOARD OF COMMISSIONERS 11
SECTION 1.(a) G.S. 153A-27.1(h), as amended by S.L. 2025-3, reads as rewritten: 12
"(h) This section shall apply only in the following counties: Alamance, Alexander, 13
Alleghany, Avery, Beaufort, Brunswick, Buncombe, Caldwell, Carteret, Caswell, Cherokee, 14
Clay, Cleveland, Cumberland, Dare, Davidson, Davie, Forsyth, Graham, Guilford, Harnett, 15
Haywood, Henderson, Hyde, Jackson, Lee, Lincoln, Macon, Madison, McDowell, Mecklenburg, 16
Moore, Onslow, Pender, Polk, Randolph, Rockingham, Rutherford, Sampson, Stanly, Stokes, 17
Transylvania, and Yancey." 18
SECTION 1.(b) This Part applies to Haywood County only. 19
SECTION 1.(c) This Part is effective when it becomes law and applies to vacancies 20
filled on or after that date. 21

PART II. PROVIDE FOR THE PARTISAN ELECTI ON OF MEMBERS OF THE 23
JACKSON COUNTY BOARD OF EDUCATION 24
SECTION 2.(a) Section 5(a) of S.L. 2024-14 reads as rewritten: 25
"SECTION 5.(a) The Jackson County Board of Education shall consist of five members 26
elected from five single -member residency districts to serve staggered four -year terms. One 27
member shall be elected from each residency district by the qualified voters of the entire county. 28
No person shall be eligible to file or be elected to the Jackson County Board of Education unless 29
the person is a qualified voter and resident of the residency district in which the candidate seeks 30
to be elected. Elections for the Jackson County Board of Education shall be held in 31
even-numbered years at the time of the general election with results determined by the 32
nonpartisan plurality method in accordance with G.S. 163-292. on a partisan basis as terms 33
expire. Candidates for election to the Jackson County Board of Education shall be nominated at 34

the same time and manner as other county officers. Members shall take office on the first Monday 1
in December following the election. Members shall serve until a successor has been elected and 2
qualified. Except as otherwise provided by this section, the election shall be conducted in 3
accordance with the applicable provisions of Chapter 115C and 163 of the General Statutes. All 4
vacancies on the Jackson Coun ty Board of Education shall be filled in accordance with 5
G.S. 115C-37.1." 6
SECTION 2.(b) This Part does not affect the term of office of any person elected in 7
2024 to the Jackson County Board of Education. Any vacancy on the Jackson County Board of 8
Education for a person elected in 2024 shall be filled by appointment by the remaining members 9
of the Jackson County Board of Education to serve the remainder of the unexpired term. Each 10
member of the Jackson County Board of Education elected in 2024, or any pers on appointed to 11
fill a vacancy for a member elected in 2024, shall serve until a successor has been elected and 12
qualified. 13
SECTION 2.(c) G.S. 115C-37.1(d), as amended by S.L. 2025-3, reads as rewritten: 14
"(d) This section shall apply only to the Asheboro C ity Board of Education, the Hickory 15
City Board of Education and the Newton-Conover City Board of Education and in the following 16
counties: Alleghany, Ashe, Beaufort, Brunswick, Burke, Cabarrus, Caldwell, Carteret, Catawba, 17
Cherokee, Clay, Craven, Dare, Davi e, Forsyth, Graham, Harnett, Henderson, Hyde, Iredell, 18
Jackson, Lee, Lincoln, Madison, McDowell, Mitchell, New Hanover, Onslow, Pamlico, Pender, 19
Polk, Rutherford, Stanly, Stokes, Surry, Vance, Washington, and Yancey." 20
SECTION 2.(d) This Part becomes effective the first Monday in December 2026. In 21
order to implement this Part, the 2026 elections shall be conducted as if the provisions of this 22
Part were already in effect. 23

PART III. ELIMINATE ETJ IN THE CITY OF JACKSONVILLE 25
SECTION 3.(a) Notwithstanding the provisions of G.S. 160D-202, or any other 26
provision of law, the City of Jacksonville shall not exercise any powers granted to cities in 27
Chapter 160D of the General Statutes in any area beyond its contiguous corporate limits. 28
SECTION 3.(b) The relinquishment of jurisdiction by the City of Jacksonville over 29
the area beyond its contiguous corporate limits shall become effective on the date this section 30
becomes law; provided, however, the City of Jacksonville's development regulations and powers 31
of enforcement shall remain in effect in that area until the time provided in G.S. 160D-202(h). 32

PART IV. EFFECTIVE DATE 34
SECTION 4. Except as otherwise provided, this act is effective when it becomes 35
law. 36
