AN ACT TO AUTHORIZE CERTAIN PERSONS, INCLUDING CERTAIN PERSONS WHO 2
DO NOT HAVE LAWFUL I MMIGRATION STATUS, T O RECEIVE IN -STATE 3
TUITION AT THE UNIVE RSITY OF NORTH CAROL INA CONSTITUENT 4
INSTITUTIONS AND NORTH CAROLINA COMMUNITY COLLEGES. 5
The General Assembly of North Carolina enacts: 6
SECTION 1. G.S. 116-143.1 is amended by adding the following new subsections 7
to read: 8
"(n) Notwithstanding any other provision of this section, a person who meets all of the 9
following qualifications shall be eligible to be charged the in-State tuition rate: 10
(1) The person graduated and received a high school diploma from a school 11
within North Carolina or received a high school equivalency diploma within 12
North Carolina. 13
(2) The person attended North Carolina schools for a minimum of two 14
consecutive years immediately prior to completing high school. 15
(3) If the person does not have lawful immigratio n status, the person submits an 16
affidavit to the State Education Assistance Authority through the coordinated 17
and centralized residency determination process within 60 days of enrollment 18
asserting that, to the extent permitted under federal law, he or she has filed an 19
application to legalize his or her status or he or she intends to file an 20
application to legalize his or her status upon becoming eligible to do so. 21
(4) The person enrolled in a constituent institution or community college. 22
(o) Any information obtained as part of the process of applying for in -State tuition 23
pursuant to subsection (n) of this section shall be confidential and is not a public record." 24
SECTION 2. This act becomes effective July 1, 2025, and applies beginning with 25
the 2025-2026 academic year. 26
