Short Title: Protect Children from Leaking Garbage Trucks. (Public)

A BILL TO BE ENTITLED 1
AN ACT TO RESTORE PU BLIC HEALTH PROTECTI ONS FROM LEAKING SOL ID 2
WASTE TRANSPORT VEHICLES. 3
The General Assembly of North Carolina enacts: 4
SECTION 1. Section 59.2 of S.L. 2013-413 is repealed. 5
SECTION 2. The Commission for Public Health shall readopt a rule substantively 6
identical to 15A NCAC 13B .0105 as it existed on August 22, 2013. Rules adopted pursuant to 7
this section are not subject to Part 3 of Article 2A of Chapter 150B of the General Statutes. Rules 8
adopted pursuant to this section shall become effective as provided in G.S. 150B-21.3(b1) as 9
though 10 or more written objections had been received as provided in G.S. 150B-21.3(b2). 10
SECTION 3. Until the effective date of the readopted rule that the Commission for 11
Public Health is required to adopt pursuant to Section 2 of this act, the Commission and the 12
Department of Environmental Quality shall implement 15A NCAC 13B .0105 as it existed prior 13
to the effective date of S.L. 2013-413. 14
SECTION 4. This act is effective when it becomes law. 15
