IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Section
1.
That
section 3722.15 of the Revised Code be enacted to read as follows:

Sec.
3722.15.
(A)
As used in this section:

(1)
"Freestanding emergency department" means a facility that
provides emergency care and is structurally separate and distinct
from a hospital.

(2)
"Physician" means an individual authorized under Chapter
4731. of the Revised Code to practice medicine and surgery or
osteopathic medicine and surgery.

(B)
During hospital emergency department or freestanding emergency
department hours of operation, the hospital or facility shall ensure
that each of the following is the case:

(1)
A physician is on duty and physically present at the emergency
department.

(2)
A physician supervises the emergency department's medical and nursing
staff and is immediately available to the staff.

(3)
A physician coordinates the emergency department's provision of
emergency care, including by being continuously involved in
appropriate components of such care.
