IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Section
1.
That
section 5101.548 of the Revised Code be enacted to read as follows:

Sec.
5101.548.
The
director of job and family services shall submit a request to the
United States department of agriculture for a waiver to exclude all
of the following as items, as defined by the United States department
of agriculture, that may be purchased in this state under the
supplemental nutrition assistance program:

(A)
Soft drinks;

(B)
Candy;

(C)
Chips;

(D)
Ice cream;

(E)
Prepared desserts such as cakes, pies, cookies, or similar products.
