Gillespie of the Senate
An Act relating to domestic abuse; creating the
Domestic Violence Offenders Registration Act;
defining terms; directing the Oklahoma State Bureau
of Investigation to create and maintain a domestic
violence offenders registry; allowing for public
access to registry; listing information for inclusion
on the registry; requiring registrants to pay
registration fee; establishing fee amount; allowing
district court clerks to retain portion of fee;
directing district court clerks to remit portion of
fee to the Bureau; providing for the removal of
registrants under certain circumstances; prohibiting
causes of action for damages; making registration
requirements applicable on certain date; directing
the Bureau to promulgate policies and procedures;
amending 74 O.S. 2021, Section 150.12B, which relates
to domestic abuse reports; clarifying procedures and
requirements for submitting reports of domestic
abuse; providing restrictions on disseminated data;
providing for codification; and providing an
effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 150.40 of Title 74, unless there
is created a duplication in numbering, reads as follows:

This act shall be known and may be cited as the "Domestic
Violence Offenders Registration Act".
SECTION 2. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 150.41 of Title 74, unless there
is created a duplication in numbering, reads as follows:
As used in this act:
1. "Convicted" and "conviction" mean a final adjudication of
guilt, whether pursuant to a plea of guilty or nolo contendere or
otherwise, and any deferred judgment or suspended sentence; and
2. "Domestic violence" means the commission of any of the
offenses provided for in Sections 644 and 644.1 of Title 21 of the
Oklahoma Statutes that meet the definition of domestic abuse, as
defined in Section 60.1 of Title 22 of the Oklahoma Statutes.
SECTION 3. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 150.42 of Title 74, unless there
is created a duplication in numbering, reads as follows:
A. The Oklahoma State Bureau of Investigation shall create a
registry of domestic violence offenders.
B. Beginning January 1, 2028, the Bureau shall maintain the
domestic violence offenders registry based upon information reported
to the Bureau in accordance with Section 150.12 of Title 74 of the
Oklahoma Statutes. The Bureau shall make the registry available for
public inquiry on the Internet. All information contained in the

registry, as provided in subsection C of this section, shall be
available to the public.
C. Upon notification that an individual has been convicted of a
domestic violence offense, as provided in Sections 644 and 644.1 of
Title 21 of the Oklahoma Statutes, the Bureau shall list the
individual on the domestic violence offenders registry. The
domestic violence offenders registry shall contain the following
information, as applicable, for each domestic violence offender:
1. Name;
2. Date of birth;
3. Plea and conviction type;
4. Conviction offense;
5. Disposition or conviction date;
6. County or counties of conviction; and
7. The most recent booking photograph of the person available
in the Automated Fingerprint Identification System (AFIS).
D. In addition to any punishment imposed for a conviction of a
domestic violence offense, a defendant required to register under
the provisions of this act shall be assessed a registration fee in
the amount of One Hundred Fifty Dollars ($150.00), which shall be
paid to the clerk of the district court imposing the sentence, who
shall:

1. Retain Fifty Dollars ($50.00) of the one-hundred-fifty-
dollar fee to cover administrative costs, which shall be deposited
in the Court Clerk's Revolving Fund; and
2. Remit One Hundred Dollars ($100.00) of the one-hundred-
fifty-dollar fee to the Bureau for administering the registry, which
shall be deposited in the OSBI Revolving Fund.
E. The Bureau shall remove from the domestic violence offenders
registry the name and other identifying information of a domestic
violence offender five (5) years after the completion of the last
sentence. Completion of the sentence shall be calculated by the
Bureau based on the sentence length and date of disposition or
conviction provided to the Bureau.
F. An individual does not have a cause of action for damages as
a result of being listed on the registry, and an individual does not
have a cause of action for damages in the event a domestic violence
offender is not listed in the registry in accordance with the
provisions of this act.
G. The provisions of this act only apply to persons convicted
of a domestic violence offense on or after January 1, 2028.
H. The Bureau shall promulgate policies and procedures to
implement and administer the provisions of this act.
SECTION 4. AMENDATORY 74 O.S. 2021, Section 150.12B, is
amended to read as follows:

Section 150.12B. A. The Director of the Oklahoma State Bureau
of Investigation shall provide forms prescribe the format for the
reporting of domestic abuse to each person for all state, county,
city, and town law enforcement agencies required to submit such
reports pursuant to the provisions of Section 3 of this act the
Domestic Abuse Reporting Act and shall establish guidelines for the
collection and reporting of domestic abuse incident information
pursuant to the provisions of the Domestic Abuse Reporting Act and
consistent with the provisions of Section 150.10 of this title.
B. The Director of the Oklahoma State Bureau of Investigation
shall compile a monthly and annual statistical report which shall
include maintain data collected regarding the number of reported
incidents of domestic abuse for each law enforcement agency, county,
and for the state as a whole, the types of crime involved in the
domestic abuse, and the days of the week the incidents occurred, and
the hours of the day the incidents occurred. The statistical
reports shall not include the names of any of the persons involved
in an incident of domestic abuse or any information which would
serve to identify such persons as individuals.
C. Copies of the monthly and annual statistical reports Data
shall be available to the public upon request. Data disseminated
shall not include the names of any victim or suspect involved in an
incident of domestic abuse or any information which would serve to
identify such individuals.

SECTION 5. This act shall become effective January 1, 2028.
